Pre-existing Industrial Issues Rule (“Conditional Member”)

A Conditional Member is a person whose application for membership has been received after a workplace or industrial issue has already arisen. Conditional Members are subject to limitations on the legal and industrial support provided by AEAWA. The AEAWA Executive reserves the right to determine the level (if any) of industrial and legal assistance available to Conditional Members.

Generally:

Conditional Members may receive guidance and support from AEAWA Delegates or Representatives.

Industrial advice from the AEAWA Industrial Team may be provided only at the discretion of the AEAWA Executive if deemed warranted and approved.

Legal representation or advocacy in tribunals, courts, or commissions is not typically provided to Conditional Members unless the AEAWA Executive determines that the issue holds significant relevance to the broader membership.

Restrictions outlined above do not apply to any workplace or industrial issues arising after membership has been approved, provided these issues are unrelated to any matters that arose prior to joining the AEAWA.
